Terms and conditions for purchasing from Smiley Succulents

Introduction

These Terms of Service govern your use of the Smiley Succulents website and the purchase of our indoor plants, succulents, and related products. By placing an order, you agree to these terms in accordance with UK consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Products and Pricing

All prices are displayed in British Pounds (£) and include VAT where applicable. We reserve the right to modify prices or discontinue products at any time.

Please note about our plants:

• Each plant is unique and may vary slightly from photographs in size, shape, and colouring

• Pot sizes and plant heights are approximate guides

• Some plants are seasonal and subject to availability

• Plants may arrive in different stages of growth depending on the time of year

Plant Care Responsibility

Once your plants are delivered, care responsibility transfers to you. We provide detailed care guides with every order. Please note:

• Plants may need time to acclimatise to their new environment (typically 1-2 weeks)

• Some leaf drop or stress is normal after transit and doesn't indicate a problem

• Following our care instructions is essential for plant health

• Succulents and indoor plants have specific light, water, and temperature requirements

Orders and Payment

By placing an order, you confirm that you are at least 16 years old and authorised to use the payment method provided. We accept:

• Credit and debit cards (Visa, Mastercard, American Express)

• PayPal

• Apple Pay and Google Pay

You will receive an order confirmation email. A contract is formed when we dispatch your order. We reserve the right to refuse or cancel orders that appear fraudulent.

Shipping and Delivery

We ship throughout the United Kingdom, including:

• UK Mainland: 2-4 working days

• Scottish Highlands and Islands: 3-5 working days

• Northern Ireland: 3-5 working days

Delivery times are estimates and not guaranteed. We use specialist plant packaging to protect your succulents and houseplants during transit. In extreme weather conditions (very hot or cold), we may delay dispatch to protect plant health.

A signature may be required upon delivery. Please ensure someone is available to receive your plants, as they should not be left outside for extended periods.

Cancellation Rights

Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods. However, please note:

• Plants are perishable goods and are exempt from the 14-day return right once dispatched

• You may cancel before dispatch for a full refund

• Non-plant items (pots, accessories) can be returned within 14 days if unused and in original packaging

Returns and Refunds

We want you to be delighted with your plants. If there's an issue:

• Damaged in transit: Contact us within 48 hours with photos. We'll arrange a replacement or refund

• Incorrect item: Contact us immediately and we'll send the correct plant

• Plant health issues: See our 30-Day Plant Health Guarantee below

Refunds will be processed within 14 days of approval to your original payment method.

30-Day Plant Health Guarantee

We're confident in the quality of our succulents and houseplants. If your plant shows signs of ill health within 30 days of delivery, and you've followed our care instructions:

• Contact us with photos showing the plant's condition

• Describe the care you've provided (watering, light, temperature)

• We'll assess and offer a replacement or store credit

This guarantee does not cover damage caused by improper care, neglect, pests from other plants, or environmental factors beyond our control.

Limitation of Liability

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

We are not liable for:

• Plant damage or death due to improper care after delivery

• Indirect or consequential losses

• Delays beyond our reasonable control

Our maximum liability is limited to the value of your order.

All content on this website, including images, text, and plant care guides, is owned by Smiley Succulents and protected by copyright. You may not reproduce or redistribute our content without permission.

Changes to Terms

We may update these Terms of Service from time to time. Changes will be posted on this page. Your continued use of our website constitutes acceptance of the updated terms.

Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. However, if you live in Scotland or Northern Ireland, you may bring proceedings in your local courts.
